I am the owner of a house and car. I have a wife and daughter to whom my belongings should be distributed after I die in case both of them survive me. I would like guidance as to how I should distribute my property and in what share they are entitled. I intend to have a wassiyat name (testament) drafted which should become effective after I die.
After funeral expenses and paying debts, if there is no wasiyah for a non heir, then the estate would be distributed between your inheritors. Should your father and mother not alive at your death, then one eighth(1/8) of your inheritance will go first to your wife. The one daughter would receive half of the estate. The remainder would go to your all your brothers and sisters alive at that time, with brother receiving twice the share of the sister.
Put the condition on the will :”Distributed according to the Mohammedan Law of Inheritance”. Our law recognize this clause as the sharia ruling of inheritance. As such the will will be verified and revised as such by muslim scholars.
