*THE PERMISSIBILITY OF STUNNING BEFORE ZABAH

*Allah Ta`ala has blessed us with a complete deen that need no adjustment until the day of qiyamah. Every issue arisen daily, be it scientific or modern already has its shar`ee solution. Ulamas are those professional divers that go deep down in the Quranic texts and Ahadiths and then serve the fiqhi juice mixture of both texts.*
 
*The issue of stunning that has come round the media has disturbed many readers since modern slaughterhouse do stunning before slaughtering. This is because our halaal meat available on the market are all stunned. The issue of mass consumption of meat/chicken need mass slaughtering. For security of the slaughter man and to limit the uncontrolled damage after slaughtering, there is the need of stunning. Stunning is to electrically numb the chicken or to hurt the bull in the head so as to limit its struggle for its life during and after slaughtering.*
 
*The Halaal Research Committee is against the concept of mechanical slaughtering. That is to use machines to slaughter animals. Because it does not comply with shari`ah requirement that necessitate a human hand slaughter with knife instrument. Beside hunting, the definition of Zabah is to slit open the throat of the animal with a sharp instrument like a knife.*
 
 *The Halaal Research Committee on the other hand, have the moderation to accept stunning. Because it simply conforms to the Qur-aan and Sunnah. We find no tolerance from the texts for mechanical slaughtering while we find tolerance for stunning provided that the animal is alive at the time of slaughtering. Because dead carcass is not halaal as specified in the ayah 173 of Surah 2 and the following ayah:*
 
حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُ وَالدَّمُ وَلَحْمُ الْخِنْزِيرِ وَمَا أُهِلَّ لِغَيْرِ اللَّهِ بِهِ وَالْمُنْخَنِقَةُ وَالْمَوْقُوذَةُ وَالْمُتَرَدِّيَةُ وَالنَّطِيحَةُ وَمَا أَكَلَ السَّبُعُ إِلَّا مَا ذَكَّيْتُمْ
 
‘’*Prohibited for you are: carrion, blood, the flesh of swine, and those upon which(a name) other than that of Allah has been invoked (at the time of slaughter), animal killed by strangulation, or killed by a blow, or by a fall, or by goring(horn injury), or that which is eaten by a beast unless you have slaughtered it.’’(5:3)*
 
*First take note from the above ayah that carrion or dead animals are haraam and impermissible for consumption.*
 
*Secondly note that if a Christian or a jew pronounced other than Allah Ta`ala`s name, then it is haraam for consumption.*
 
*Thirdly, if an animal is injured voluntarily or involuntarily but finally was slaughtered before death, then the animal is indisputably halaal and consumable.*
 
Different tafseers describe the same meaning:

{ حُرّمَتْ عَلَيْكُمُ الميتة } أي أكلها { والدم } أي المسفوح كما في ( الأنعام ) [ 145 : 6 ] { وَلَحْمُ الخنزير وَمَا أُهِلَّ لِغَيْرِ الله بِهِ } بأن ذبح على اسم غيره { والمنخنقة } الميتة خنقاً { والموقوذة } المقتولة ضرباً { والمتردية } الساقطة من علو إلى أسفل فماتت { والنطيحة } المقتولة بنطح أخرى لها { وَمَا أَكَلَ السبع } منه { إِلاَّ مَا ذَكَّيْتُمْ } أي أدركتم فيه الروح من هذه الأشياء فذبحتموه

وقوله: { إِلا مَا ذَكَّيْتُمْ } عائد على ما يمكن عوده عليه، مما انعقد سبب موته فأمكن تداركه بذكاة، وفيه حياة مستقرة، وذلك إنما يعود على قوله: { وَالْمُنْخَنِقَةُ وَالْمَوْقُوذَةُ وَالْمُتَرَدِّيَةُ وَالنَّطِيحَةُ وَمَا أَكَلَ السَّبُعُ }
وقال علي بن أبي طلحة، عن ابن عباس في قوله: { إِلا مَا ذَكَّيْتُمْ } يقول: إلا ما ذبحتم من هؤلاء وفيه روح، فكلوه، فهو ذكي. وكذا رُوي عن سعيد بن جبير، والحسن البصري، والسدي.
وقال ابن أبي حاتم: حدثنا أبو سعيد الأشَجّ، حدثنا حَفْص بن غياث (1) حدثنا جعفر بن محمد، عن أبيه، عن علي قال: { وَمَا أَكَلَ السَّبُعُ إِلا مَا ذَكَّيْتُمْ } قال: إن مَصَعَتْ بذنبها أو رَكَضَتْ برجلها، أو طَرَفَتْ بعينها فكُلْ.
وقال ابن جرير: حدثنا القاسم، حدثنا الحسين، حدثنا هشيم وعباد قالا حدثنا حجاج، عن حصين، عن الشعبي، عن الحارث، عن علي قال: إذا أدركت ذكاة الموقوذة والمتردية والنطيحة، وهي تحرك يدًا أو رجلا فكلها.
وهكذا رُوي عن طاوس، والحسن، وقتادة وعُبَيد بن عُمير، والضحاك وغير واحد: أن المذكاة متي تحركت بحركة تدل على بقاء الحياة فيها بعد الذبح، فهي حلال. وهذا مذهب جمهور الفقهاء، وبه قال (2) أبو حنيفة والشافعي، وأحمد بن حنبل. وقال ابن وهب: سُئل مالك عن الشاة التي يخرق جوفَها السَّبُعُ حتى تخرج أمعاؤها؟ فقال مالك: لا أرى أن تذكى أيّ شيء يُذَكَّى منها.

Allama Shami r.a. concluded the same fatwa after considering all thesis: ‘’And the preferred view is that any(consumable) animal that is slaughtered when it is still alive, then it will be eaten(halaal). And Fatwa is on this view. (This is because the ayah above mentioned) ‘’unless you have slaughtered it.’’ is mentioned without any attached conditions. (Fatawa Shami)    

وَالْمُخْتَارُ أَنَّ كُلَّ شَيْءٍ ذُبِحَ وَهُوَ حَيٌّ أُكِلَ ، عَلَيْهِ الْفَتْوَى - { إلَّا مَا َكَّيْتُمْ } - مِنْ غَيْرِ تَفْصِيلٍ

We find the definition of alive in Shami itself as the state of movement after slaughtering.(Haskafi;Shami)

أنه يكفي من الحياة قدر ما يبقى في المذبوح

Stunned animals have that amount of movement and life after stunning. Hence it is permissible to eat from stunned animals.
 
Nonetheless, if the animal is found dead after stunning, then it is a carrion and a carcass and hence haraam. Slaughtering it will not render it halaal.
 
Halaal monitoring organizations should verify the stunning be to norm to keep the animal alive at slaughtering time.
