L’avortement de par la loi d’exception
La vie est sacrée. Si sacrée qu’une seule vie peut valoir l’humanité toute entière. Le Coran est très explicite à ce sujet: " Celui qui a tué un être humain innocent ou par perversion, alors (pour Dieu) c’est égal au massacre de l’humanité. " (Ch 5 Verset 32).
Le Prophète Muhammad (saw) dit: "Dieu n’a pas de pitié pour celui qui n’a pas pitié pour les humains." (Boukhari). En une autre occasion, le Prophète Muhammad (pssl) dit: " Ayez pitié sur les êtres terrestres, Celui du ciel aura pitié sur vous" (Tirmizi).

L’Islam accorde la considération à l’homme vivant ou mort. Le Prophète Muhammad (paix soit sur lui) a dit : « Briser les os d’un mort est comme si on les brisait de son vivant. » (Abu Dawood). Même avant la conception, à l’état de fœtus ou même de sperme, le Prophète a établis des consignes sur le respect de la progéniture.

Au fait selon un récit de Muslim, un compagnon a questionné le Prophète sur l’action d’éjaculer à l’extérieur du vagin afin d’éviter la conception. Le Prophète a qualifié cet acte « d’infanticide en secret ». (Abu Dawood), quoique d’autres récits élaborent sur une permission de l’acte, mais avec réserve (Bukhari) La vie est donc comptée même à l’état de sperme. Que dire sur l’avortement d’un fœtus !

C’est grave, et c’est encore beaucoup plus grave après l’insufflement de l’âme. Au niveau de la législation islamique, l’avortement n’est pas considéré comme un homicide volontaire. Ici on doit comprendre que même si une action est grave, mais la Charia la condamne pour l’au-delà, et c’est traité sans punition ici-bas. Par exemple, médire c’est manger la chair de son frère (49 :12), mais la législation n’exige pas de couper la chair de l’autre par la loi du Talion. Donc même si la législation ne condamne pas la maman pour son avortement, c’est grave et on recueille parmi les codes de loi islamique l’obligeance de libérer un esclave (Bukhari) ou de payer 500 dirhams (Rs 80000 a ce jour) au père de l’enfant.

Au fait, l’insufflement de l’âme se fait au 120eme jour du fœtus(Bukhari). C’est pour cela que l’avortement d’un fœtus de 120 jours ou plus est aussi grave que si on a tuait un humain. Mais avant cela, le fœtus est en état de caillot et de chair ,et donc son avortement est relativement moins grave, selon les juristes.

Cependant, l’Islam est une religion à s’adapter à toute condition et même à l’extrême. C’est ainsi que les juristes en se basant sur le Coran et les Hadith ont autorisé l’avortement d’un fœtus de moins de 120 jours dans des cas très critiques et exceptionnels.

Tout comme il est permis à consommer le porc (en absence d’une autre alternative) pour sauver sa vie contre la famine. Je cite ici quelques exceptions ouu l’avortement peut être considéré :

1. La vie de la maman est mise en danger.
2. Le fœtus est mort.
3. Un cas de viol.
4. Génocide ethnique.
5. Inceste.

Après l’adoption du dernier projet de loi sur l’avortement en cas exceptionnels, les législateurs devraient prendre en considération la tendance générale de l’avortement : Débarrasser les grossesses indésirables. Donc la permission à l’état d’exception que prévoit la loi devrait être très rigidement observée. Un panel de juristes du code pénal ainsi que des juristes religieux devraient être consultés avant qu’on ne procède à tout avortement.

Pour le musulman, puisque cela concerne la famille, le Muslim Family Council peut trancher dans différents cas. Le mariage ou le nikah d’un musulman est reconnu officiellement par les institutions de par l’existence du Muslim Family Council. Savez vous que beaucoup de pays n’ont pas une telle structure ?
 
Donc les cas d’avortement peuvent être approuvés par le Muslim Family Council afin d’assurer et que les cas en examen sont authentiques.

Finalement les religieux doivent être les garde-fous afin de ne pas ouvrir la porte à l’abus, comme le trafic d’organes ou de fœtus. Wallahou a’lam bis sawab.
